Terms of Service
Effective June 1, 2026
These terms govern your use of Calamus ("the Service"), an AI-powered thought leadership content service operated by Steven Emch ("Calamus," "we," "us"). By subscribing, you agree to these terms.
1. The Service
Calamus produces thought leadership articles tailored to your voice, audience, and industry. We build a voice profile from your intake responses and reference content, then deliver original articles via Google Docs or email on a recurring schedule.
The Service is designed for business use. By subscribing, you represent that you are acting on behalf of a business entity.
2. Subscriptions & Billing
- Plans — Starter (2 articles/month), Growth (4 articles/month), and Scale (8 articles/month), priced at $249, $449, and $799 per month respectively. Each plan begins with a one-time $19 Pilot Article, credited toward your first month if you subscribe.
- Pilot Article — The one-time $19 Pilot fee is credited toward your first month if you subscribe, and is refundable in full on request if you are not happy with the pilot. Credit and refund eligibility expire 30 days after the pilot is delivered. Once a subscription begins, the pilot is non-refundable and normal cancellation terms apply.
- Billing — Monthly, processed by Stripe on the anniversary of your subscription start date.
- Cancellation — You may cancel at any time by emailing us. Cancellation takes effect at the end of your current billing period. No refunds for partial months.
- Price changes — We'll give you at least 30 days' written notice before any price increase. Existing subscriptions are honored at their current rate until renewal after notice.
3. Content Ownership
- You own all delivered content. Once an article is delivered, all rights transfer to you. You may publish, modify, and distribute it without restriction or attribution.
- Pre-delivery — Drafts in progress remain Calamus property until delivery.
- Service improvement — We retain the right to use anonymized, aggregated process data (not your content, voice profile, or business information) to improve our methodology. We will never publish, share, or use your actual content for any purpose other than delivering it to you.
4. Revisions
Every article includes one round of revisions, at all stages of the service — pilot and subscription alike. Submit your revision requests by email or by commenting directly in your delivered Google Doc, and we'll address them in a single pass. We aim to turn around revisions within 2 business days, though timelines may vary based on the scope of changes requested.
5. Content Delivery
Articles are delivered via Google Docs (to a Drive folder you specify) or email, depending on your preference. Delivery requires a valid Google OAuth connection or email address on file.
We make reasonable efforts to deliver articles on schedule but do not guarantee specific delivery dates. Occasional delays may occur due to research complexity, revision cycles, or service maintenance.
6. Your Responsibilities
- Provide accurate intake information and timely feedback on your pilot article
- Keep a valid payment method active with Stripe
- Review delivered content before publishing — you are responsible for fact-checking and compliance with your industry's regulations
- Do not use the Service to produce content that is illegal, defamatory, or deliberately misleading
7. No Guarantees
Calamus produces high-quality thought leadership content, but we do not guarantee specific outcomes including search engine rankings, traffic, leads, revenue, or audience growth. Content performance depends on many factors outside our control.
8. Limitation of Liability
To the maximum extent permitted by law, Calamus's total liability for any claims arising from or related to the Service is limited to the fees you paid in the three months preceding the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data, regardless of whether we were advised of the possibility of such damages.
9. Confidentiality
We treat your intake data, voice profile, business information, and all delivered content as confidential. We will not disclose your information to third parties except as required to operate the Service (see our Privacy Policy) or as required by law.
10. Termination
Either party may terminate the subscription at any time. Upon termination, we will deliver any articles already in production. Your stored data is retained for 30 days after cancellation (see our Privacy Policy for data retention details).
We reserve the right to suspend or terminate accounts that violate these terms or use the Service for prohibited purposes.
11. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
12. Governing Law
These terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law provisions. Any disputes arising from these terms will be resolved in the courts of Indiana.
